Terms of Sale
The owner of the online shop www.wendre.ee (hereinafter online shop) is Aktsiaselts Wendre (reg. no 110120596) (hereinafter Wendre or seller), located at Lina 31, 80041 Pärnu.
Term of sales contract and information about goods and prices
The sales terms apply to purchasing goods from the online shop.
The prices of the products sold in the online shop are indicated next to the products. A fee for delivery of the goods is added to the price.
The fee for delivery of the goods depends on the location of the buyer and the delivery method. The delivery fee is displayed to the buyer when the order is placed.
Information about the goods is provided in the online shop next to the goods.
Aktsiaselts Wendre is liable for VAT (KMKR EE100110997). All prices in this online shop include 22% VAT. The prices in our online shop are in euros (€) and the billing currency is euro (€).
Placing an order
To order goods, the requested goods should be added to the shopping cart. To finalize the order, the required data fields should be filled in and a suitable means of delivery chosen. The total price is then displayed on the screen, which can be paid safely via following payment solutions:
Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Revolut, N26.
Payments are mediated by Maksekeskus AS. Payment takes place outside the online shop in a secure environment – when paying with a bank link, in the secure environment of the respective bank. The seller does not have access to the details of the buyer’s bank. The owner of the online shop is the controller of personal data and forwards the personal data necessary for making payments to the data processor Maksekeskus AS.
The contract enters into force after the amount subject to payment has been credited to the bank account of the online shop.
If it is not possible to deliver the ordered goods due to lack of stock or another reason, the buyer will be notified as soon as possible and the cost paid (including delivery fees) will be refunded immediately but not later than 14 days after the notification was sent.
Orders placed in the online shop are processed Mon-Fri 10:00-17:00.
Delivery
Goods are delivered to the following countries:
- Estonia 1-3 days.
In exceptional cases, the goods may be delivered within a time frame of up to 30 calendar days.
The delivery cost of the goods is borne by the buyer and the respective price information is displayed next to the delivery method.
In Estonia, parcels will normally arrive at the location specified by the buyer within 1-3 working days of entry into force of the sales contract.
The buyer can pick up the goods themselves at the Pärnu factory store (Lina 31, 80041 Pärnu) and in Wendre store in Tallinn (Järve Keskus, Pärnu mnt 238, Tallinn). The buyer can choose to send the goods to the parcel machine (Itella, DPD, Omniva) or by courier (DPD, Omniva).
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract entered into with the online shop within 14 days. The right of withdrawal does not apply if the buyer is a legal person.
To exercise the 14-day right of withdrawal, the buyer may not use the ordered goods in any other way than is necessary in order to examine the nature, properties and functioning of the goods in the same way the buyer would be allowed to test the goods in a physical shop, the returned goods must be free of defects, complete and in original undamaged packaging.
If the products have been used in any other way than is necessary for verifying the nature, characteristics or functionality of the goods or they have wear marks, the online shop has to refuse to take back the goods. The seller is not obliged to accept a return if blankets/pillows/bed linen/mattresses, etc are not eligible for return for hygiene reasons and which have been used after delivery in any other way than can be done in a physical store.
The return and exchange of defective goods is carried out in accordance with the requirements of the legislation of the Republic of Estonia, in particular in accordance with the conditions provided in the Law of Obligations Act.
- If the product purchased by the buyer is defective, the buyer has the right to return or exchange the given product.
- The seller cancels the order and returns the money if replacement of the product is not possible.
In order to replace or return the defected goods, the buyer should comply with the following conditions:
- The buyer must notify the seller of the defect of the goods within a reasonable time from the moment when the buyer became aware of the defect or should have become aware of it, to the address shop@wendre.com. The application form can be accessed HERE.
- The buyer must attach the purchase invoice to the products that accompanied the goods.
- The buyer must submit the return application with the goods either in writing or send it to the address of online shop shop@wendre.com. The application form can be accessed HERE.
- According to Law of Obligations Act, the costs of replacing the defected goods will be borne by the seller, including transportation and postal costs.
- Damage caused by contact with chemicals, heat, sharp objects, moisture, as well as damage caused by the product not being used as intended or stored incorrectly, are not considered defects. In this case, the product will not be replaced or the purchase amount will not be refunded.
- The seller is not obliged to eliminate at his own expense defects in products from which laundry labels or product labels have been removed.
Having received the returned goods, the online shop refunds the buyer any amounts received from the buyer on the basis of the contract immediately but no later than within 14 days of receiving the application for withdrawal.
The online shop may refuse to process the refund until it receives the item that is the object of the contract or until the buyer submits proof that the item has been sent back, whichever happens first.
If the buyer has explicitly chosen a method of delivery different from the most inexpensive normal method of delivery offered by the online shop, the online shop is not required to refund to the buyer the amount exceeding the cost of normal delivery.
The online shop has the right to withdraw from the sales transaction and request that the goods be returned by the buyer if the marked price of the goods in the online shop is significantly lower than the market price of the goods due to an error.
The money will be transferred back to the buyer’s same bank account from which the receipt reached the online shop.
A refund will be made to the buyer after the returned product has reached the warehouse of the online shop, but not later than within 14 days.
If the buyer and the online shop fail to resolve a dispute by reaching an agreement, the buyer has the right to turn to the Consumer Disputes Committee.
Force majeure
Wendre online shop is not responsible for the damage caused to the buyer or for the delay in the delivery of the goods if the damage or the delay in the delivery of the goods is due to circumstances that Wendre online shop could not influence or foresee.
Direct marketing and processing of personal data
The online shop uses the personal data entered by the buyer (incl. name, phone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. The online shop transmits personal data to transport companies in order to deliver the goods.
The online shop sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish to receive them by entering their e-mail address on the website and announcing their wish to receive direct mail notifications.
The buyer can unsubscribe from the offers and newsletters sent to the e-mail at any time by notifying Wendre by e-mail or by following the instructions in the e-mail containing the offers.
Right to file a complaint
The online shop is liable for the non-compliance of the goods sold to the buyer with the terms and conditions of the contract or for the defects which existed at the time of delivery of the item and which become evident within up to two years of the delivery of the goods to the buyer. Within the first year after the item was delivered to the buyer, it is presumed that the defect already existed at the time of delivery.
The buyer has the right to turn to the online shop within two months of the occurrence of a defect by sending an e-mail to the address shop@wendre.com or calling: +372 449 0770.
In the event of a defect in the goods, Wendre asks you to stop using the goods.
The repair or replacement of defective goods shall be agreed between Wendre online shop and the buyer. The cost of repair is covered by the seller.
Wendre online shop is not responsible for defects in the product due to the buyer's fault, which have arisen as a result of improper storage or non-purposeful use of the product.
In the event of non-compliance or defects of the product, Wendre asks you to send the complaint to the e-mail address shop@wendre.com, indicating the name of the person who placed the order, contact phone number, order number and the exact description of the non-compliance or defect of the product.
A complaint about the discovery of non-conformity or defects of the product must be submitted within two months from the discovery of the non-conformity or defect of the product.
All complaints will be reviewed and the buyer will be contacted as soon as possible, but not later than within 14 days from the receipt of the complaint.
The buyer has the right to demand from Wendre online shop a reduction of the purchase price or termination of the contract and a refund for the goods if it is not possible to repair or replace the goods, the repair or replacement of the goods fails, Wendre online shop has not eliminated the defect of the goods within a reasonable time or unreasonable inconveniences have been caused to the buyer.
Resolution of disputes
If a buyer has complaints regarding the online shop, they should send them via e-mail to shop@wendre.com or call: +372 449 0770. The online shop responds to the consumer’s complaint within 15 days in writing or in a format that can be reproduced in writing.
If the buyer and the online shop fail to resolve a dispute by reaching an agreement, the buyer has the right to turn to the Consumer Disputes Committee. The Consumer Disputes Committee is authorized to resolve disputes arising from the contract entered into between the buyer and the online shop.
